Application Terms of Use

1. Provider

The Application is provided by Net Income CZ s.r.o., Company ID (IČO) 24206229, Ramonova 3466/4, Prague 10, 100 00, Czech Republic, email info@netincome.cz.

2. Using the Application

We grant you a personal, non-exclusive, non-transferable and revocable licence to install and use the Application on Android devices that you own or control, for your own non-commercial purposes and in accordance with these Terms. The Google Play Terms of Service also apply to downloading and using the Application.

The Application is currently free of charge. It may display advertising, as described in section 6.

3. Age requirement

Six Pack Please: AI Photo is intended only for users aged 18 and over. By using it, you confirm that you are at least 18 years old.

4. Photos and AI results (Six Pack Please: AI Photo)

Photos you upload

When you take or choose a photo, you confirm that:

• the photo shows you, or a person who has agreed to their photo being edited in this way;
• no one in the photo is under 18 years old;
• the photo contains no nudity or sexual content;
• you have the right to use the photo and using it does not infringe anyone else's rights, such as copyright or the right to privacy.

You keep all rights to your photos. You allow us and the AI image-processing provider acting on our behalf to process each photo only to create the result you requested and to run the automated safety checks, and to keep the photo and the result for up to 7 days to check the quality of results and the safety checks. How photos are handled is described in section 4 of our Privacy Statement.

Automated safety checks may refuse a photo, for example when it appears to show nudity or a child. We may refuse to process a photo that breaks these Terms.

AI results

• Results are created automatically by artificial intelligence and are meant for entertainment only.
• They do not show your real body, a real or achievable fitness result, or what you would look like after any diet, training or treatment. They are not medical, health, nutrition or fitness advice.
• Results may be inaccurate, unexpected or different each time, and we cannot guarantee any particular outcome.

You may save and share results for personal, non-commercial purposes. You are responsible for how you use and share them. You must not present a result as a real, unedited photo in a way that could mislead others, for example as proof of a training or diet programme, and you must not use results to harass, embarrass, impersonate or deceive anyone.

Reporting

If a result is offensive or inappropriate, please report it using the flag button on the result screen, or contact us at info@netincome.cz.

5. Acceptable use

When using the Application, you must not:

• break the law or infringe the rights of others;
• try to get around, disable or test the limits of the safety checks;
• use the Application to create sexual, hateful, violent or otherwise harmful content;
• copy, modify, reverse engineer or redistribute the Application, except where the law expressly allows it;
• access the Application or its services by automated means, or overload, disrupt or misuse them.

We may restrict or stop your access to the Application or its online features if you break these Terms.

6. Advertising

The Application shows advertising provided by third parties, for example while an image is being created. Where the law requires it, the Application asks for your consent to personalised advertising, and you can change your choice at any time in the Application's settings. More details are in our Privacy Statement.

7. Intellectual property

The Application, including its design, graphics, texts and software, is owned by Net Income or its licensors and is protected by intellectual property laws. These Terms do not give you any rights to it beyond the licence in section 2.

8. Availability and changes

We continuously develop the Application and may add, change or remove features. The AI image service depends on online processing and may sometimes be slow or unavailable. We do not guarantee that the Application will always be available, error-free or compatible with every device.

9. Disclaimer and limitation of liability

To the extent permitted by law, the Application is provided "as is" and "as available", without warranties of any kind beyond those required by law. To the extent permitted by law, we are not liable for indirect or consequential damage, lost profits or lost data arising from your use of the Application or of the results it creates.

Nothing in these Terms limits our liability for damage caused intentionally or through gross negligence, or for harm to life, body or health, and nothing in these Terms affects the rights you have as a consumer under mandatory law.

10. Privacy

How we process personal data, including photos, is described in our Application Privacy Statement.

11. Changes to these Terms

We may update these Terms when the Application or legal requirements change. We will publish the updated version on this page and revise the "Last updated" date. Material changes may also be communicated in the Application. If you continue to use the Application after an update, the updated Terms apply.

12. Governing law and disputes

These Terms are governed by the laws of the Czech Republic. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live.

If you have a complaint, please contact us first at info@netincome.cz. Consumers may also use out-of-court dispute resolution through the Czech Trade Inspection Authority (Česká obchodní inspekce, www.coi.cz). Disputes are otherwise decided by the competent courts of the Czech Republic, without prejudice to consumers' rights to bring proceedings in their country of residence.
